Waiver of Liability

I understand that participating in this escape room activity entails risks such as:

a) Lifting or moving small objects weighing less than five pounds

b) Use of simple tools

c) Being in small, enclosed spaces with up to 5 people

d) Possibility of tripping, slipping, and bumping into other participants

or objects

e) Possibility of falling objects

f) Mental stress and anxiety

g) Possibility of failing to complete the activity in the allotted time

I have no physical or mental ailment or impairment that would prevent me from participating in this activity safely for myself and others, and I am not under the influence of drugs or alcohol that would impair my ability to participate in this activity safely for myself and others. I agree that escape room staff, at their sole discretion, may determine if it is unsafe for myself or others for my participation to continue and may remove me from the premises by any lawful means.

I hereby assume all risks for participating in this activity including, but not limited to, risks arising from my own negligence, negligence or carelessness on the part of the persons or entities being released, negligence in the construction, maintenance and upkeep of the facility and its equipment, negligence in training and supervision, or because of their possible liability without fault.

I understand that I am participating in this activity at my own risk. I agree that Cross Point Church, its affiliates, employees, members, service providers, and volunteers who have constructed or are operating the escape room, collectively and individually, are waived, discharged, and released from any and all liability and are not responsible for any injuries that I might incur as a result of my participation in this activity including physical injury to my person or property, expense and/or loss sustained by me, medical expenses, or mental anguish or distress.

I agree to indemnify, hold harmless, and promise not to sue Cross Point Church, its affiliates, employees, members, service providers, and volunteers for any claims I may have, now or in the future, pertaining to any liabilities waived.

I agree and consent to undergo medical treatment which may be deemed advisable in the event of injury, accident, and/or illness while participating in this activity. I hereby authorize any licensed physician, emergency medical technician, hospital, or other medical/health care facility to provide medical treatment to myself or to the designated minor child for who I am signing for the purpose of treating or relieving such injuries and consent to the administration of all medical care. I have adequate medical insurance to cover any injuries to myself and my children and I agree to bear the costs of such treatment of any injury.

While at the facility, I agree to conduct myself in a responsible manner and will refrain from engaging in inappropriate conduct, including the use of loud, foul, slanderous language or any intimidating or offensive conduct that would interfere with the peaceful use and enjoyment of the facility by other users. I agree to follow all escape room rules, policies, and procedures as posted in the facility, on the website, or explained to me. I accept that I am responsible for my actions and behavior during this activity and that I may be held liable for damage I do to the escape room and any of its features or property.

I accept that, to monitor my progress throughout the game, I will be viewed on video camera and, as such, I have no expectation of privacy while inside the activity room, but that video will not be broadcast or recorded.

I certify that I have read and fully understand this form and agree to be bound by it during this and all subsequent visits to any escape rooms that I may participate in at Cross Point Church. I am aware that by signing this release of liability, I am waiving certain legal rights including the right to sue Cross Point Church, its affiliates, employees, members, service providers, and volunteers who have constructed or are operating the escape room. My online electronic signature substitutes for and has the same legal standing as if I had signed a physical paper copy of this waiver.

This Escape Room Waiver Form will be interpreted broadly in order to provide a release and waiver to the fullest extent permissible by law.

If the participant listed below is a minor, I certify that I am the minor’s parent or guardian and that I have the power to enter into this agreement and discharge obligation in the minor’s behalf.
